UPDATE: Charges Dropped in Reported $641,000 Embezzlement Scandal at Millsboro American Legion

(MILLSBORO, Del.)- The Department of Justice has dropped the charges against the 'post officers' of the American Legion Post #28 in Millsboro, accused of having been involved in an alleged $641,000 embezzlement scandal.

Due to information discovered after the time of arrest that requires additional investigation, charges have been dismissed against four individuals and are expected to be dismissed against the fifth, acording to the DOJ.

However, there is an active, continuing criminal investigation.

In January 2016, the American Legion Post #28, Millsboro, reported to the Department of Safety & Homeland Security, Delaware Division of Gaming Enforcement (DGE) that six post officers, either past or present, had stolen funds from the American Legion between July 2012 - January 2015.

Among the suspects, James Gallagher, who has been the Department 1st Vice Commander at American Legion Department of Delaware for the past year and 10 months, according to his LinkedIn account online. Gallagher holds a high-up position within the American Legion Department of Delaware.

The investigation revealed the suspects, who were Post #28 officers at the time, wrote and signed numerous checks out to cash, cashed the checks at local banks and the funds were not returned to or used for American Legion Post #28 business.

On Thursday, April 07, 2016 investigators with DGE concluded a three month felony theft investigation, totaling $641,100.00. Investigators obtained arrest warrants on the suspects for charges related to embezzlement and executed a search warrant at the residence of Samuel Mauger, 25000 block of Pear St, Millsboro, DE. Five suspects were arraigned & released pending a later court date. Note- A sixth suspect was identified for stealing $218,040.00 in funds; however, the suspect is deceased.
