Erratic Driver Gets 4th DUI Offense, Heroin Charges
The incident occurred around 1:30 p.m. Saturday March 26, 2016, when the Sussex County Emergency Operations Center (9-1-1) began receiving calls about a white passenger car driving erratically on southbound Sussex Highway (US13) south of Seaford. The car was then reported to be stopped in the right turn lane at the intersection with US13 and Ockels Drive with the operator slumped over the steering wheel.
Troopers located the white Chevrolet Cavalier and contacted the driver, who was identified as Philip B. Spear, 29 of Millsboro, and an odor of alcohol was detected. While interviewing Spear, troopers observed an empty heroin bag stuck to the outside of his shirt. A state police K9 then conducted an exterior search of the vehicle and gave a positive indication of an illegal narcotic within the car.
When troopers conducted a search of the vehicle, three bags of heroin with a weight of .045 grams were located on the passenger's seat as well as syringes and other drug paraphernalia.
A DUI investigation ensued and Spear was subsequently transported back to Troop 5 where an inquiry into his driving record revealed he had three previous DUI convictions (06/07/06, 08/23/10, and 06/04/13,) this arrest would make #4.
Philip Spear was charged with 4th Offense Driving Under the Influence of a Combination of Alcohol and Any Drug, Possession of Heroin, and Possession of Drug Paraphernalia. He was arraigned a JP3 and committed to Sussex Correctional Institution on $5,000.00 cash bond.
